A settlement has been reached with Gas Express, LLC d/b/a Circle K (“Circle K” or “Defendant”) in a class action lawsuit. This case is about the targeted cyberattack on Circle K's computer systems that occurred in May 2024 (the “Data Incident”). Certain files that contained Private Information were accessed. These files may have contained personal information such as names and Social Security numbers.
The lawsuit is called Brittany Canup, et al. v. Gas Express, LLC d/b/a Circle K, Case No. 25EV012357. It is pending in the State Court of Fulton County, Georgia (the “Litigation”). Circle K denies that it did anything wrong, and the Court has not decided who is right. The parties have agreed to settle the lawsuit (the “Settlement”) to avoid the costs and risks, disruptions, and uncertainties of continuing the Litigation.
